Throughout these Terms, “we”, “us” and “our” refer to MontePierré Ltd trading as Theresa Rézeau Fine Art.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and services to you.

2. These Terms

These Terms of Service govern your use of this website and purchases made through it.

By using our website or purchasing a product, digital edition, membership or other service from us, you agree to these Terms together with any other policies applicable to your purchase, including our Privacy Policy, Return and Refund Policy and Purchase Options Cancellation Policy.

Nothing in these Terms excludes, restricts or overrides any rights you have under applicable consumer law.

3. Our Website and Services


Theresa Rézeau Fine Art provides art-related products, publications, editorial content and services, which may include:


  • original artworks and other physical items;
  • digital editions and publications;
  • The Image & Culture Journal;
  • memberships and subscriptions; and
  • other art-related products, content and services that we may offer from time to time.


We may update, modify or discontinue parts of the website or Services where reasonably necessary. This will not affect rights you have in relation to purchases already made.


4. Product and Artwork Information


We take reasonable care to ensure that descriptions, dimensions, dates, attribution information, photographs and other information relating to artworks and products are accurate.


Images displayed on screens may vary slightly from the appearance of physical artworks or products because of differences in photography, lighting, screen calibration and device settings.


Where an artwork is unique, its individual characteristics, age, materials and condition may form part of the nature of the work.


Any significant condition information known to us and relevant to a purchasing decision will be disclosed where appropriate.


Please contact us before purchasing if you require additional information about a particular artwork.


5. Prices


Prices are displayed on the website in the currency indicated at the time of purchase.


The total price payable and any applicable delivery charges, taxes or other mandatory charges will be displayed or otherwise clearly communicated before you complete your order.


We may change prices at any time, but a change will not affect an order that we have already accepted.


If we discover an obvious pricing error before accepting or fulfilling an order, we will contact you and give you the opportunity to proceed at the correct price or cancel the order.


6. Orders


Submitting an order constitutes an offer to purchase the relevant product or service.


We may decline or cancel an order where reasonably necessary, including where:


  • an item is no longer available;
  • there has been an obvious pricing or description error;
  • payment has not been authorised;
  • we reasonably suspect fraud or unauthorised activity;
  • delivery cannot reasonably be made to the destination provided; or
  • we are legally prohibited from completing the transaction.


If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.


7. Payment


Payment must be made using one of the payment methods available at checkout.


Payments may be processed by Shopify Payments or other payment service providers. Payment providers may process your information in accordance with their own terms and privacy policies.


You agree to provide current, complete and accurate billing and payment information when making a purchase.


8. Physical Artworks and Products


Physical artworks and other physical products will be delivered to the address provided during checkout or otherwise agreed with you.


Delivery times shown or communicated are estimates unless we expressly agree otherwise.


For valuable, fragile or unique artworks, specialist packing, insurance or delivery arrangements may be required.


Risk in physical goods passes to you in accordance with applicable consumer law.


Your rights to cancel an eligible online purchase or return physical goods are explained in our Return and Refund Policy.


Nothing in these Terms affects your statutory rights where goods are faulty, damaged, not as described or otherwise fail to conform to the contract.


9. Digital Editions


Digital editions and other downloadable publications are supplied electronically and may be made available for immediate access following purchase.


Where, before supply begins, you expressly consent to immediate supply of digital content and acknowledge that this means losing your statutory cancellation right, your 14-day cancellation right ends when supply of the digital content begins.


Digital editions supplied in those circumstances are non-refundable once supply has begun, except where the digital content is faulty, not as described or where a refund or other remedy is required by law.


Purchase of a digital edition grants you a limited licence for your personal, non-commercial use.


Unless expressly authorised by us, you must not reproduce, distribute, resell, upload, publish, share or commercially exploit a digital edition or substantial part of it.


10. Memberships and Subscriptions


Certain content or Services may be available through a paid membership or subscription.


The applicable price, billing frequency and benefits will be displayed before you subscribe.


Where a membership is offered on a recurring basis, payments will recur at the frequency shown at the time of purchase until the membership is cancelled.


You may cancel a recurring membership in accordance with our Purchase Options Cancellation Policy.


Cancellation prevents future renewals. Access to membership benefits will ordinarily continue until the end of the period for which you have already paid, subject to your statutory rights and any terms communicated when you subscribed.


We may make reasonable changes to membership content or benefits over time. Where a change materially affects an existing paid subscription, we will provide any notice required by applicable law.


11. Intellectual Property


Unless otherwise stated, the editorial content, essays, text, website design, branding, graphics and original materials published by Theresa Rézeau Fine Art and The Image & Culture Journal are owned by or licensed to MontePierré Ltd and are protected by applicable intellectual property laws.


Images of artworks may be owned by artists, estates, museums, galleries, photographers or other rights holders and remain subject to the rights of their respective owners.


Nothing on this website transfers ownership of intellectual property rights to you.


You may access website content for your own personal, non-commercial use.


You must not reproduce, republish, distribute, sell, commercially exploit or systematically extract our original content without prior written permission, except where permitted by law.


12. Purchasing an Artwork Does Not Transfer Copyright


Unless expressly agreed otherwise in writing, purchasing an original artwork or other physical work does not transfer copyright or other intellectual property rights in that work.


Ownership of the physical artwork and ownership of copyright are separate.


Any reproduction, publication, commercial use or licensing of an artwork remains subject to the rights of the relevant copyright owner.


13. Acceptable Use


You must not use our website:


  • for unlawful or fraudulent purposes;
  • to infringe the rights of another person;
  • to introduce viruses, malicious code or other harmful technology;
  • to attempt unauthorised access to the website, servers or associated systems;
  • to interfere with the security or operation of the Services; or
  • to systematically scrape, harvest or extract website content or data in a manner that infringes our rights or applicable law.


We may restrict access where reasonably necessary to protect the website, our customers, our rights or the security of our Services.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
